AI Laws in South Africa

South Africa has no enacted AI statute and no operative national AI policy. A draft National AI Policy was gazetted for comment in March 2026, but the responsible department withdrew it after confirming that its reference list contained fictitious sources; Cabinet approved the withdrawal on June 5, 2026 so the policy could be reworked. Businesses must therefore assess AI systems under the laws already in force, led by POPIA for personal data and supplemented by consumer, competition and electronic-transactions law. The withdrawn draft is recorded as history, not counted as law or guidance in force.

Penalty: No AI-specific penalty exists. Regulatory exposure comes through POPIA, consumer, competition and electronic-transactions law rather than a standalone AI offence.

South Africa has no binding AI-specific legislation in force that we track. That does not mean AI is ungoverned there. The official frameworks below are in effect and set out what regulators expect — and general law (data protection, consumer protection, sectoral and anti-discrimination rules) still applies to AI systems in the ordinary way. None of these is legislation and none creates a legal obligation by itself, so they are counted separately from binding law — never added to it. See our scope definition.
